1 Acceptance and contracting parties
These Customer Terms govern access to and use of CashOnPick’s website, applications, call-centre and related services. The platform is operated by OCOM Private Limited. By creating an account, requesting a quotation or pickup, confirming a transaction, or otherwise using the service, the customer agrees to these Terms and the policies incorporated by reference.
CashOnPick coordinates the transaction. Unless CashOnPick expressly identifies itself on a transaction record as the purchaser, the assigned pickup partner is the purchaser of the customer’s item. The final sale contract is concluded between the customer and that partner when the customer accepts the final inspected price, receives confirmed payment, and hands over the item.
2 Eligibility
The customer must be at least 18 years old and legally capable of contracting.
The customer must be the lawful owner of the item or have verifiable authority from the owner to sell it.
Information supplied about the customer and item must be accurate, complete and current.
CashOnPick or the partner may request reasonable identity, ownership, invoice, serial-number or other verification before completing a transaction.
3 Quotation and request
An online, app, telephone or message-based price is an indicative quotation based on the customer’s answers, current demand and available information. It is not a guaranteed purchase price or an obligation to purchase. Quotations may have a stated validity period and may change when the period expires, market conditions change, incorrect information is supplied, or physical inspection reveals a mismatch.
Submitting a request authorises CashOnPick to share the necessary request details with an assigned partner. CashOnPick may accept, reject, reassign, pause or cancel a request for serviceability, safety, verification, suspected fraud, partner availability or operational reasons.
4 Inspection and revised price
At pickup, the partner may inspect the item’s identity, specifications, functionality, cosmetic condition, repairs, locks, accounts, accessories and other relevant attributes. The inspection should be conducted transparently at the registered pickup location. If the item differs from the declared condition, the partner may offer a revised price and must explain the material reasons.
The customer may accept or reject the revised price without a cancellation charge. No partner may pressure the customer to accept. If rejected, the item remains with the customer and the request is cancelled or rescheduled as appropriate.
5 Customer preparation and data removal
Back up all personal data before pickup.
Sign out of Apple, Google, Microsoft and other accounts; disable activation, device-management and anti-theft locks; remove SIM and memory cards; and perform an appropriate factory reset where possible.
Remove confidential information and ensure the item is ready for lawful transfer.
Disclose material defects, repairs, replacement parts, liquid damage, finance or lease restrictions, insurance claims and ownership issues.
The partner may assist with reset steps, but the customer remains responsible for backups and removal of personal data. CashOnPick and the partner are not responsible for loss of customer data that should have been backed up or removed before handover, except to the extent liability cannot lawfully be excluded.
6 Payment and handover
The partner must make the agreed payment through the available method and provide or trigger an appropriate transaction record. The customer must verify receipt or confirmed payment before releasing the item. The customer should not hand over an item based only on a promise of later payment. Title and risk transfer to the purchaser only after confirmed payment and voluntary physical handover, subject to reversal for fraud, unlawful ownership or a failed/reversed payment.
7 Cancellation and rescheduling
The customer may cancel or reschedule before payment and handover through the available account, support or contact channel. CashOnPick presently does not charge a customer cancellation fee, but repeated abusive, false or unsafe requests may lead to restrictions. After payment and handover, a completed sale generally cannot be cancelled merely because the customer changes their mind.
8 Prohibited items and conduct
Stolen, lost, counterfeit, unlawfully obtained, encumbered or financed items that cannot lawfully be transferred.
Items subject to an insurance claim, police report, ownership dispute, corporate asset restriction or active device lock not disclosed to CashOnPick.
Items containing illegal material or presented using false identity, forged records or manipulated condition information.
Threats, harassment, discrimination, unsafe pickup conditions, bribery, collusion, platform circumvention, data scraping or interference with the website or app.
CashOnPick or the partner may refuse a transaction and may preserve or disclose relevant records to lawful authorities when reasonably required.
9 Platform and partner responsibilities
CashOnPick will use reasonable efforts to provide the platform, coordinate requests, communicate status and address complaints. Partners are independent businesses responsible for their personnel, inspection, purchase decision, payment, collection, statutory registrations, taxes and conduct. CashOnPick requires partner standards and may investigate or suspend a partner, but does not guarantee that every request will be accepted, attended at a particular time or completed at the initial quotation.
10 Communications
The customer agrees to receive OTPs and service communications necessary to administer a request by call, SMS, email, app notification or WhatsApp. Promotional communications require the permissions applicable to that channel and can be opted out of. Opting out of promotions will not stop essential transaction or security messages.
11 Intellectual property and acceptable use
CashOnPick and its licensors own the platform, software, branding and original content. Users receive a limited, revocable, non-transferable right to use the service for lawful personal transactions. Users may not scrape, copy, reverse engineer, bypass controls, introduce malicious code, impersonate others, misuse pricing data or commercially exploit the platform without written permission.
12 Disclaimers and liability
The service is provided on an as-available basis. To the maximum extent permitted by law, CashOnPick does not guarantee uninterrupted access, a buyer for every item, a particular pickup time, or the initial quoted price. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including applicable consumer rights.
To the maximum extent permitted by law, CashOnPick will not be liable for indirect, incidental, special or consequential loss, loss of data, profits or opportunity, or a partner’s independent acts, except where caused by CashOnPick’s fraud, wilful misconduct, gross negligence or a liability that cannot be limited.
13 Indemnity
The customer is responsible for loss reasonably arising from their unlawful sale, lack of ownership or authority, fraud, material misrepresentation, violation of law or infringement of third-party rights. This provision does not require a consumer to indemnify CashOnPick for CashOnPick’s own wrongdoing or remove non-waivable legal rights.
14 Suspension and termination
CashOnPick may restrict or terminate access for fraud, abuse, security risk, repeated false requests, unlawful conduct or material breach. The customer may stop using the service and request account closure, subject to lawful record retention. Clauses intended by their nature to survive will continue after termination.
15 Complaints, governing law and jurisdiction
Customers should first use the Grievance Redressal Policy. These Terms are governed by Indian law. Subject to mandatory consumer rights and jurisdiction, courts at Bengaluru, Karnataka will have jurisdiction. Nothing prevents a consumer from using a competent consumer commission or another forum available under applicable law.
16 Changes
CashOnPick may update these Terms. Material changes will apply prospectively after reasonable notice where required. Continued use after the effective date constitutes acceptance, but a completed transaction remains governed by the version accepted for that transaction unless law requires otherwise.
